User Rights & Data Protection (GDPR)
1) Right to Access
You have the right to request confirmation from the data controller regarding whether your personal data is being processed. If such processing exists, you have the right to request information about:
-
The purposes for which the personal data is processed;
-
The categories of personal data being processed;
-
The recipients or categories of recipients to whom your personal data has been or will be disclosed;
-
The planned duration of storage or, if specific details are not possible, the criteria for determining the storage period;
-
The existence of the right to rectification, deletion, restriction of processing, or objection to such processing;
-
The existence of a right to file a complaint with a supervisory authority;
-
Any available information about the origin of the data, if it was not collected directly from you;
-
The existence of automated decision-making, including profiling, as per Article 22(1) and (4) GDPR, and—at least in such cases—meaningful information about the logic involved, as well as the significance and intended impact of such processing.
You also have the right to know if your personal data is transferred to a third country or an international organization. In this context, you may request to be informed about the appropriate safeguards as per Article 46 GDPR related to the transfer.
2) Right to Rectification
You have the right to request the correction or completion of inaccurate or incomplete personal data processed by the data controller. The rectification must be carried out without undue delay.
3) Right to Erasure ("Right to be Forgotten")
3.1) You may request the immediate deletion of your personal data, and the data controller is obligated to delete the data without delay if any of the following conditions apply:
-
Your personal data is no longer necessary for the purposes for which it was collected or otherwise processed.
-
You withdraw your consent on which the processing was based (Article 6(1)(a) or Article 9(2)(a) GDPR) and there is no other legal basis for processing.
-
You object to processing pursuant to Article 21(1) GDPR, and there are no overriding legitimate reasons for the processing, or you object to processing for direct marketing under Article 21(2) GDPR.
-
Your personal data was unlawfully processed.
-
The deletion is required to comply with a legal obligation under EU or member state law.
-
Your personal data was collected in relation to information society services as per Article 8(1) GDPR.
3.2) If the controller has made your personal data public and is required to delete it under Article 17(1) GDPR, they must take reasonable measures, including technical measures, to inform other data controllers processing the data that you have requested the deletion of all links, copies, or replications of this personal data.
3.3) The right to deletion does not apply if processing is necessary for:
-
Exercising the right to freedom of expression and information;
-
Compliance with a legal obligation required by EU or national law, or performing a task in the public interest or in the exercise of official authority;
-
Reasons of public interest in the field of public health under Article 9(2)(h) and (i) and Article 9(3) GDPR;
-
Archival purposes in the public interest, scientific or historical research, or statistical purposes under Article 89(1) GDPR, where deletion would likely render the achievement of processing goals impossible or seriously impair them;
-
The establishment, exercise, or defense of legal claims.
4) Right to Restriction of Processing
You have the right to request the restriction of processing of your personal data under the following conditions:
-
If you dispute the accuracy of the personal data, for a period allowing the controller to verify its accuracy.
-
If the processing is unlawful, but you oppose deletion and request restriction instead.
-
If the controller no longer needs the personal data, but you require it for establishing, exercising, or defending legal claims.
-
If you have objected to processing under Article 21(1) GDPR, and it has not yet been determined whether the controller’s legitimate grounds outweigh yours.
If processing is restricted, the data may only be processed (apart from storage) with your consent, for the establishment, exercise, or defense of legal claims, for protecting another natural or legal person’s rights, or for important public interest reasons of the EU or a member state. If the restriction is lifted, you will be notified beforehand.
5) Right to Notification
If you have exercised your right to rectification, deletion, or restriction of processing, the controller is required to inform all recipients to whom your personal data has been disclosed, unless this is impossible or involves disproportionate effort. You have the right to be informed about these recipients.
6) Right to Data Portability
You have the right to receive your personal data that you have provided to the controller in a structured, commonly used, and machine-readable format. You also have the right to transfer this data to another controller without hindrance, provided that:
-
The processing is based on consent (Article 6(1)(a) GDPR or Article 9(2)(a) GDPR) or a contract (Article 6(1)(b) GDPR).
-
The processing is carried out by automated means.
Additionally, you have the right to request direct transmission of your data to another controller, where technically feasible, as long as this does not adversely affect the rights and freedoms of others. This right does not apply where processing is necessary for a task in the public interest or the exercise of official authority.
7) Right to Object
You have the right to object at any time to the processing of your personal data under Article 6(1)(e) or (f) GDPR, including profiling based on these provisions. The controller will no longer process your personal data unless they can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights, and freedoms, or the processing serves to establish, exercise, or defend legal claims.
If your data is processed for direct marketing purposes, you have the right to object at any time, including related profiling. If you object, your personal data will no longer be used for this purpose.
You also have the right to exercise this objection through automated means using technical specifications, notwithstanding Directive 2002/58/EC.
8) Right to Withdraw Consent
You have the right to withdraw your consent at any time. The withdrawal of consent does not affect the lawfulness of processing conducted before the withdrawal.
9) Automated Individual Decision-Making
You have the right not to be subject to a decision based solely on automated processing—including profiling—if this decision produces legal effects concerning you or significantly affects you in a similar way. This does not apply if the decision:
-
Is necessary for entering into or performing a contract;
-
Is authorized by law and includes appropriate safeguards for your rights and freedoms;
-
Is based on your explicit consent.
However, such decisions must not be based on special categories of personal data under Article 9(1) GDPR, unless adequate safeguards are implemented.
10) Right to Lodge a Complaint
You have the right to file a complaint with a supervisory authority in the EU member state of your residence, workplace, or the alleged violation if you believe that the processing of your personal data violates GDPR.
The supervisory authority will inform you of the progress and outcome of your complaint, including the possibility of seeking judicial remedies under Article 78 GDPR.
